Notification of intention to incorporate by reference: updated AANZFTA PSRs

Pursuant to Schedule 2, clause 1 of the Legislation Act 2019, I, the Chief Executive of the New Zealand Customs Service, give notice of the intention to incorporate by reference Chapter 3 Annex 3B (Product Specific Rules) into Part 6 of the Customs and Excise Regulations 1996. The document sets out the rules of origin provisions agreed under the Second Protocol to the AANZFTA Agreement as signed on 21 August 2023. I propose incorporating this document by reference in the Customs and Excise Regulations 1996 as an alternative to its full text being stated in those regulations. 

Chapter 3 Annex 3B (Product Specific Rules) is available for inspection on the Ministry of Foreign Affairs’ website at the following link: Text of Second Protocol to Amend AANZFTA. Alternatively, this document is available for inspection, at no charge, between the hours of 9.00am and 4.30pm Monday to Friday (excluding statutory holidays) at The Customhouse, 1 Hinemoa Street, Wellington 6011. You are invited to make comment on the proposal to incorporate the Chapter 3 Annex 3B (Product Specific Rules) by reference in the Customs and Excise Regulations 1996.
