Notification of intention to incorporate by reference

Pursuant to Schedule 2, clause 1 of the Legislation Act 2019, I, the Chief Executive of the New Zealand Customs Service, give notice of the intention to incorporate by reference the documents listed below into Part 6 of the Customs and Excise Regulations 1996,
The documents set out the rules of origin provisions agreed under the New Zealand European Union Free Trade Agreement signed on 9 July 2023. I propose incorporating these documents by reference in the Customs and Excise Regulations 1996 as an alternative to their full text being stated in those regulations.
The documents I propose incorporating by reference into Customs and Excise Regulations 1996 are:
- Chapter 3 (Rules of origin and origin procedures)
- Annex 3-A (Introductory notes to product-specific rules of origin)
- Annex 3-B (Product-specific rules of origin)
- Annex 3-C (Text of the statement on origin)
- Annex 3-D (Supplier’s declaration referred to in Article 3.3(4) (Cumulation of origin))
- Annex 3-E (Joint declaration concerning the Principality of Andorra)
- Annex 3-F (Joint declaration concerning the Republic of San Marino)
These documents are available for inspection on the Ministry of Foreign Affairs’ website at the following link - NZ-EU FTA text and resources | New Zealand Ministry of Foreign Affairs and Trade (mfat.govt.nz). Alternatively, these documents are available for inspection, at no charge, between the hours of 9.00am and 4.30pm Monday to Friday (excluding statutory holidays) at The Customhouse, 1 Hinemoa Street, Wellington 6011. You are invited to make comment on the proposal to incorporate the above documents by reference in the Customs and Excise Regulations 1996. To submit comments, email: PolicyTrade@customs.govt.nz.
